DoorDash driver pleads guilty to fatally striking man in Cowlitz County

The DoorDash driver police say fatally struck a man in early October and left the scene pleaded guilty and was sentenced on Wednesday in Cowlitz County Superior Court.

Shelby Dawn Toland, 33, of Longview, was sentenced to 41 months, or three years and five months, in state prison.

She pleaded guilty to felony hit-and-run resulting in death, which occurred when she struck Howard K. Eby, 62, as he was crossing the street on Oct. 4 at the intersection of 11th Avenue and Washington Way near the recently closed Bruno's Pizza.

Eby is described as a transient living in the Longview area, according to court records. 

Toland's sentencing range was between 31 to 41 months, with Cowlitz County Superior Court Judge Thad Scudder selecting the higher range. 

According to the arresting document, the collision took place around 1:49 a.m., when officers found the injured Eby laying in the street. Eby sustained pelvic fractures, a brain bleed, a spinal fracture, and more.

Police say nearby video surveillance shows Eby leaving the Silver Star Sports Bar & Grill on Vandercook Way at 1:41 a.m., then walking down an alleyway toward 11th Avenue. 

Footage from the Triangle Tavern on Washington Way, also shows Toland's maroon Toyota Highlander heading towards 11th Avenue at about 1:44. A few seconds later, a thud can be heard in the video, the report states.

Before that, footage from the Ocean Beach Highway McDonald's reportedly placed the maroon Toyota Highlander at the fast-food joint.

A McDonald's employee told authorities that order was placed through the DoorDash mobile delivery app, and police found Toland was the driver, court records show.

The damaged Toyota Highlander was discovered on Oct. 9 at a residence linked to Toland, and a person who knew her said she admitted to striking a person with her car that October night, the report continues.
