Last year, Washington’s Growth Management Hearings Board ruled Clark County was in noncompliance with state law for approving an overlay allowing surface mining before sufficient environmental impact studies were conducted. Though the Court of Appeals is examining the decision, the county has since lost $6.4 million in state funds, as the overlay has not been repealed. The Clark County Council agreed to hold a public hearing on whether or not to repeal the overlay.
